1. About this policy

This Privacy Policy explains how Seeking Health, LLC ("Seeking Health," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit our website, create an account, place an order, or otherwise interact with our products and services (collectively, the "Services"). Seeking Health is the business and data controller responsible for the personal information described here.

We are committed to protecting your privacy and handling your data responsibly. At Seeking Health, we value transparency and respect your privacy choices. Depending on where you live, you may have specific rights related to how your personal information is collected, used, shared, and stored.

This policy is the central description of our privacy practices. The specific privacy rights available to you, and the forms used to exercise them, depend on where you live and are handled on dedicated pages listed in section 8

2. Personal information we collect

Depending on how you interact with us, we may collect the following categories of personal information. The category names follow the framework used by U.S. state privacy laws so they map cleanly to the rights described in Section 8.

  • Identifiers - real name, alias, postal address, email address, phone number, account name, unique personal identifiers, online identifiers, and IP address.
  • Customer records (Cal. Civ. Code § 1798.80(e)) - registration and contact details, and payment information necessary to process a purchase. We do not retain full payment card numbers; card payments are handled by our payment processors.
  • Commercial information - products and services purchased, considered, or returned, and other order and purchasing history.
  • Internet or network activity - browsing and search activity on our site, interactions with pages and emails, and device/diagnostic information such as browser type, settings, and crash data.
  • Geolocation data - approximate location derived from IP address or similar signals.
  • Protected classification characteristics - only if you choose to provide them (for example, age or other attributes shared in surveys, reviews, or support requests).
  • Audio/visual information - customer service recordings, photos, or reviews you submit.
  • Inferences - preferences and characteristics we derive from the above to personalize your experience.
  • Sensitive personal information - account login credentials. Because we sell health and wellness products, your purchases or inquiries may also reveal information related to your health interests. See Section 6.

We do not knowingly collect more sensitive information than is needed to provide the Services.

3. Where we get personal information

We collect personal information from three main sources:

  • Directly from you - when you create an account, place an order, subscribe to emails, enter a promotion, contact support, or post a review.
  • Automatically - through cookies and similar technologies when you use our site.
  • From third parties - such as payment processors, shipping carriers, analytics and advertising providers, fraud-prevention services, and platforms you use to interact with us.

If you provide us with personal information about another person, you confirm you have that person's permission to do so.

4. How we use personal information

We use personal information to:

  • Process and fulfill orders, returns, subscriptions, and rewards.
  • Create and manage your account and authenticate users.
  • Provide customer support and respond to your inquiries.
  • Send transactional messages and, where permitted, marketing communications.
  • Personalize and improve the Services and develop new features.
  • Measure and analyze how the Services are used.
  • Protect the security and integrity of the Services and prevent fraud and abuse.
  • Comply with legal obligations and enforce our terms and policies.

We process personal information only for purposes that are reasonably necessary and compatible with the reasons it was collected, or for which you have given consent where consent is required.

Legal bases for processing (EEA and UK). If you are in the European Economic Area or the United Kingdom, we process your personal information only where we have a lawful basis under the EU/UK General Data Protection Regulation. The basis we rely on depends on the purpose:

  • Performance of a contract (Article 6(1)(b)) - to process and fulfill your orders, returns, and subscriptions; to create, manage, and authenticate your account; to administer rewards programs you enroll in; to send transactional messages about your orders or account; and to provide customer support relating to a purchase.
  • Our legitimate interests (Article 6(1)(f)) - to operate, personalize, and improve the Services and develop new features; to measure and analyze how the Services are used; to respond to general inquiries; to keep the Services secure and prevent fraud and abuse; and to establish, exercise, or defend legal claims. Where we rely on legitimate interests, we weigh those interests against your rights and proceed only where they are not overridden. You may object to this processing through our GDPR Privacy Requests page.
  • Your consent (Article 6(1)(a)) - to send marketing communications where consent is required, and to set non-essential cookies and similar technologies for analytics and advertising. You may withdraw consent at any time, which does not affect processing already carried out.
  • Compliance with a legal obligation (Article 6(1)(c)) - to meet our legal, tax, accounting, and regulatory requirements and to respond to lawful requests from public authorities.

Where our products, or your purchases or inquiries, reveal information about your health, that information may constitute special category data under Article 9. We process it only with your explicit consent (Article 9(2)(a)) or where another Article 9 condition applies, such as the establishment, exercise, or defense of legal claims. If we cannot rely on a lawful basis for a particular activity, we will not carry it out unless and until you provide any required consent.

5. How we disclose personal information

We may disclose personal information to the following categories of recipients:

  • Service providers and processors that perform functions on our behalf - for example, hosting, order fulfillment and shipping, payment processing, email and customer-support tools, analytics, and fraud prevention. These parties are permitted to use the information only to provide services to us.
  • Advertising and analytics partners that help us understand site performance and deliver relevant advertising.
  • Affiliates and business partners where reasonably necessary to provide or improve the Services.
  • Legal and safety recipients - courts, regulators, or law enforcement when we believe disclosure is reasonably necessary to comply with law, respond to lawful requests, or protect the rights, property, or safety of Seeking Health, our users, or others.
  • Successors in connection with a merger, acquisition, financing, or sale of assets.

Sale, sharing, and targeted advertising. We do not sell personal information for money. However, our use of certain advertising and analytics cookies may be considered a "sale" or "sharing" of personal information, or "targeted advertising," under some U.S. state privacy laws. You can opt out of this activity, including through a Global Privacy Control (GPC) signal where supported, on our Do Not Sell or Share My Personal Information page.

Because our products relate to health and wellness, information about the products you view or purchase may suggest interests related to your health. We treat this information with care and do not use or disclose it for purposes that would require a separate right to limit its use under applicable law beyond what is described in this policy.

If you are a resident of a state with a consumer-health-data law (such as Washington's My Health My Data Act or Nevada's consumer health data law), additional protections may apply to health-related information, and we will obtain consent where those laws require it. 7. Cookies and tracking technologies

We use cookies and similar technologies to operate the site, remember your preferences, analyze usage, and support advertising. You can manage your preferences through our cookie settings and, where supported, through a Global Privacy Control (GPC) browser signal. Because there is no industry-standard for how to respond to Do Not Track (DNT) browser signals, our site does not currently respond to them. You can still opt out of the sale or sharing of your personal information.

8. Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, or receive a portable copy of your personal information; to opt out of the sale or sharing of personal information and of targeted advertising; to opt out of certain profiling; and to limit the use of sensitive personal information. You also have the right not to receive discriminatory or retaliatory treatment for exercising these rights.

9. Financial incentives and loyalty programs

We offer programs such as our Rewards Program and Subscribe & Save that may provide price discounts, points, or other benefits in connection with the collection and use of personal information. Under some U.S. state privacy laws these may be considered "financial incentives." Participation is voluntary; you may join or withdraw at any time through your account or by contacting us. The material terms of each program are presented when you enroll. We offer these programs in good faith, and any difference in price or service reflects the reasonable value of your participation rather than penalizing you for exercising privacy rights.

10. How long we keep personal information

We retain personal information only as long as needed for the purposes described in this policy, including providing the Services, meeting legal, tax, accounting, and security obligations, resolving disputes, and enforcing our agreements. When information is no longer needed, we delete it or take reasonable steps to de-identify it. Retention periods vary depending on the type of information and the reason we hold it.

11. How we protect personal information

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or destruction. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

12. Children's privacy

Our Services are directed to people 16 years of age and older, and we do not knowingly collect personal information from children under 16, consistent with the Children's Online Privacy Protection Act (COPPA). We also do not knowingly sell or share the personal information of consumers under 16 years of age, or use such information for targeted advertising, without the consent required by applicable law. If you believe a child has provided us with personal information, please contact privacy@seekinghealth.com and we will take appropriate steps to delete it.

13. CAN-SPAM Act

The CAN-SPAM Act is a U.S. law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions
  • Process orders and send information and updates pertaining to orders
  • Send you additional information related to your product and/or service
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred

To be in accordance with CAN-SPAM, we agree to the following:

  • Not use false or misleading subjects or email addresses
  • Identify the message as an advertisement in some reasonable way
  • Include the physical address of our business or site headquarters
  • Monitor third-party email marketing services for compliance, if one is used
  • Honor opt-out/unsubscribe requests quickly
  • Allow users to unsubscribe by using the link at the bottom of each email

14. International data transfers

Seeking Health is based in the United States, and personal information we collect is primarily processed and stored in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. Where required, we rely on appropriate safeguards for such transfers, as described on the applicable region-specific page above. We may transfer, store and process your personal information outside the country you live in. If we transfer your personal information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

15. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where required, provide additional notice. We encourage you to review this page periodically.

16. Text Messaging Opt-Out

Seeking Health may send you text messages in relation to promotional offers. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again. Mobile opt-in information won't be shared with third parties for marketing purposes.

If you are experiencing issues with the SMS program, you can reply with the keyword HELP for more assistance, or you can get help directly at 1-800-547-9812 or at customer@seekinghealth.com. Please note that message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

17. Use of Your Information for Artificial Intelligence

We do not use your personal information to train artificial intelligence or machine learning models, and we do not sell, share, or otherwise provide your personal information to third parties for that purpose. Any AI tools we use to operate our business and serve you are used in a manner that does not train those tools on your personal data.

18. Categories of Service Providers and Data Recipients

We work with third-party service providers (processors) who handle personal information on our behalf to operate our business and provide our products and services. We do not authorize these providers to use your personal information for their own purposes. The categories of providers we engage, and the purpose of each, are described below:

  • E-commerce platform and hosting. Providers that host our online stores and process the personal information you submit when you browse, create an account, or place an order, including your contact, account, and order details.
    • Relationship with Shopify: The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.   • Payment processing. Providers that securely process payment card and transaction information to complete your purchases. Full payment card details are handled by these providers and are not stored by us.
  • Fraud prevention and transaction security. Providers that screen orders and transactions to detect and prevent fraudulent activity, using order, device, and payment-related information.
  • Subscription and recurring billing management. Providers that manage recurring subscription orders and associated billing, using your account, order, and payment information.
  • Marketing and customer communications. Providers that send email and SMS messages on our behalf, including order updates, promotions, and other communications, using your contact details and engagement information (subject to your consent and marketing preferences where required).
  • Loyalty and rewards program management. Providers that administer our loyalty and rewards program, using your account and purchase activity to track points, rewards, and redemptions.
  • Affiliate and referral program management. Providers that track referrals and affiliate-driven purchases, using order and referral-source information to attribute and manage referral rewards.
  • Customer support and helpdesk. Providers that operate our customer service tools, using your contact details and the contents of your inquiries to respond to and resolve support requests.
  • Analytics and website performance measurement. Providers that help us understand how visitors use our sites, including page activity, usage trends, and session behavior, so we can measure and improve performance. This may involve cookies and similar technologies and the collection of online identifiers.

    • We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising.   • Advertising and retargeting. Providers that help us deliver and measure advertising across other websites and platforms, including showing you relevant ads based on your activity.
